Ferkelkram

Content Policy

Last updated: October 2026 (draft)

This Content Policy sets out what content you may create or edit using Ferkelkram’s AI tools, what content is prohibited without exception, and what requirements apply to uploaded photos and other source materials. It applies to all prompts, uploads and outputs, regardless of whether the content is stored only privately, downloaded or used outside Ferkelkram. The German version is legally binding.

1. Principles of Use

Ferkelkram is an AI studio for creating and editing images and short videos featuring fictional adults. All prompts, uploads and outputs must be lawful, respect the rights of others and comply with the rules below.

Storing content privately in your personal library does not exempt it from this Content Policy. Prohibited content remains prohibited even if it is not published or shared with others.

You are responsible for your prompts, uploads, the edits you request and any subsequent use of downloaded outputs. In particular, you must respect rights of personality, data protection rights, copyrights, trademark rights and other third-party rights.

2. What You May Create

Subject to the law and the restrictions below, you may in particular create or edit the following content:

– Images and short videos of entirely fictional people who are clearly adults.

– Fashion, glamour, editorial, fantasy, lifestyle and cinematic content featuring adult characters.

– Lawful sensual, erotic or intimate depictions featuring only clearly adult, fictional people.

– Image edits, outfit changes, virtual photo shoots, and motion and video scenes based on your own source materials or source materials you are legally entitled to use.

– Duo, couple and kissing scenes between adults, provided that the depiction appears consensual and does not infringe the rights of any real person.

– Experiments involving style, lighting, backgrounds, poses and characters, provided that neither the prompts nor the outputs violate this Policy or applicable law.

3. What Is Never Permitted

The following content and uses are prohibited without exception. This also applies to attempts to create such content only in part, in disguised or coded form, or through multiple successive editing steps.

Minors and depictions of unclear age

– Depictions of minors, people who appear to be minors, or people whose adult status is not clearly apparent, in any sexual, erotic, intimate or otherwise inappropriate context.

– Content featuring childlike, adolescent or age-ambiguous characteristics, particularly in connection with nudity, sexualisation, fetishes or adult situations.

– Sexualised depictions involving terms, roles, clothing, settings or narratives that suggest a person is underage. Merely claiming that a depicted person is an adult is insufficient if that person appears to be a minor or of unclear age.

– Content that depicts, promotes, trivialises or simulates the sexual abuse or sexual exploitation of children.

Real people, identity and lack of consent

– Use of a real person’s face, body, voice, name or other identifying characteristics without that person’s prior, informed and freely given consent.

– Non-consensual intimate images or videos, or the creation, editing or sexualisation of images or recordings of a real person without that person’s express consent.

– Deceptive deepfakes, face swaps, impersonations or other content that falsely suggests that a real person did, said or depicted something.

– Imitations or sexualised depictions of celebrities, public figures or any other identifiable real person without that person’s consent. Public prominence or the availability of photos online does not replace consent.

– Content intended to demean, defame, harass, expose, threaten, blackmail or deliberately deceive real people.

Violence, hate and other harmful content

– Depictions or glorification of violence, abuse, torture, mutilation or killing, or specific threats to commit such acts.

– Non-consensual sexual acts, sexualised violence, coercion, exploitation, or depictions in which valid consent is clearly absent.

– Hate speech or content that attacks, dehumanises or discriminates against people based on protected characteristics, or incites hatred or violence against them.

– Content intended to facilitate targeted harassment, stalking, blackmail, intimidation or the disclosure of another person’s private information.

Illegal content and attempts to circumvent safeguards

– Content whose creation, possession, processing or distribution is unlawful or infringes third-party rights.

– Content that promotes, prepares or facilitates criminal offences, or depictions that provide specific assistance for unlawful acts.

– Uploads or edits that infringe copyrights, trademark rights, data protection rights, rights of personality or other third-party rights.

– Attempts to circumvent, deceive or disable security filters, moderation systems, technical safeguards or usage restrictions of Ferkelkram or any AI providers used by Ferkelkram.

4. Consent and Rights for Uploads

You may upload photos, videos and other source materials only if they depict you or if every identifiable person has consented to the specific use. All depicted persons must be adults.

Consent must have been given freely, knowingly and unambiguously before the upload. It must also cover the intended AI editing and the type of output requested. Intimate or sexualised edits require express consent to that specific use.

– A previous relationship, friendship or other personal connection does not constitute consent.

– Publication of a photo online or on social media does not constitute consent to AI editing.

– Consent to ordinary image editing does not automatically include intimate, sexualised or deceptive editing.

– Silence, failure to object or mere possession of an image file does not constitute consent.

You must be able to provide evidence of the required consent and your rights of use upon request. If there is any doubt as to whether a person has consented or whether you are entitled to use source material, you must not upload the file.

You must not upload private, intimate or identifying images or recordings of another person without that person’s express consent. If consent is withdrawn with effect for the future, you must not use the affected content again and must delete any existing content from your library unless another legal basis applies.

5. Automated Moderation

Ferkelkram uses automated checks for prompts and uploads. In particular, texts, images, settings and technical signals may be checked to determine whether they violate this Content Policy, the Terms of Use or applicable law.

A generation may be rejected automatically before it begins or while it is being processed. AI model and inference providers used by Ferkelkram may also carry out their own safety checks and reject requests.

Automated systems are not error-free. Permitted content may be rejected by mistake, and prohibited content may not be detected in every case. Reports, uncertain cases and potential violations may therefore also be reviewed by authorised personnel where necessary for handling the matter, ensuring safety, enforcing legal rights or complying with legal obligations.

Circumventing automated checks, including through deliberate misspellings, coded instructions, image manipulation or dividing a prohibited activity into multiple steps, constitutes a separate violation of this Policy.

6. Reporting Content and Legal Violations

Illegal content and violations of this Content Policy may be reported through the following point of contact. It also serves as the point of contact for notices under the notice-and-action mechanism pursuant to Article 16 of the Digital Services Act (DSA):

Ferkelkram GmbH Email: [email protected] Available languages of communication: German and English

A report should be as precise and complete as possible and should include, in particular, the following information:

– A sufficiently substantiated explanation of why you consider the reported content to be illegal or in violation of this Content Policy.

– The exact electronic location of the content, such as a URL, content ID, generation ID or transaction ID, and, where necessary, screenshots or other information that allows the content to be located unambiguously.

– Your name and email address, unless this information is not required due to a statutory exception.

– A statement confirming your good-faith belief that the information contained in the report is accurate and complete.

If the output was published outside Ferkelkram, you should also explain why you believe it was created using Ferkelkram and identify any user account or process that may be involved. Ferkelkram cannot remove content from third-party websites or platforms, but it may investigate potential violations within its own service and take any necessary action there.

Where contact details have been provided, we will generally acknowledge receipt of a report electronically. We review reports promptly, carefully, objectively and without arbitrariness. If the information provided is insufficient for an assessment, we may request further information.

Where required by law, we will inform the reporting and affected persons of our decision, the principal reasons for it, the use of automated means and any available avenues of redress. Statutory duties of confidentiality and obligations to protect affected persons remain unaffected.

7. Consequences of Violations

If you violate this Content Policy, we may take the following measures in particular, depending on the nature, severity, frequency and circumstances of the violation:

– Reject or terminate a prompt or generation.

– Restrict access to specific content or remove content from the library.

– Temporarily or permanently disable certain functions.

– Temporarily suspend or permanently terminate the affected user account.

– Implement technical measures to prevent repeated violations and attempts to circumvent safeguards.

– Preserve evidence where permitted or required by law.

– Report illegal content or conduct to the competent authorities or other bodies designated by law, particularly where there is reason to suspect criminal offences, child abuse, specific threats or serious legal violations.

In the event of a serious violation, we may take action without prior warning. Repeated violations and attempts to circumvent our protective systems may result in permanent account suspension.

Where required by law, the affected person will receive a statement of reasons for the decision. You may object to a moderation decision by emailing [email protected] and specifying the user account and process concerned, together with the reasons for your objection. Statutory rights, including the right to refer a matter to the competent authorities or courts, remain unaffected.

8. Abusive Reports and Complaints

Reports and objections must be submitted accurately, to the best of your knowledge and in good faith. Repeatedly submitting manifestly unfounded reports, knowingly providing false information or misusing the reporting procedure to harass others may result in restrictions on the handling of further submissions and, in the case of Ferkelkram users, measures against the relevant account.

Before taking such action, we will consider in particular the number, severity, proportion and timing of abusive reports or complaints. Where appropriate, we will issue a warning first.

9. Changes to This Content Policy

We may amend this Content Policy if the features of the service, the AI systems used, the applicable law or security requirements change. The current version will be published on ferkelkram.de. We will provide appropriate notice of material changes.

This Content Policy supplements Ferkelkram’s Terms of Use and Privacy Policy. In the event of any conflict, mandatory statutory provisions will prevail, followed by the Terms of Use.
